Contrairement à ce que je lis à gauche et à droite, Il n’y a pas de contradiction entre les Arrêts des Cours de Chambéry et de Paris.
- La Cour de Chambéry dit que l’AGRR ne peut plus aujourd’hui obliger une entreprise qui a résisté jusque là, à adhérer au régime de branche.
- La Cour de Paris dit qu’une entreprise qui a déjà adhéré au régime de branche ne peut pas invoquer la décision du conseil constitutionnel pour résilier à la fin de l’année alors que la clause de désignation est encore en vigueur.
