Pour la première fois, une décision de justice vient de prendre en compte la volonté du patient pour justifier l’arrêt des traitements. Le Conseil d’Etat souligne que « que l’état médical le plus grave, y compris la perte irréversible de toute conscience, ne peut jamais suffire à justifier un arrêt de traitement » mais estime « qu’une attention toute particulière doit être accordée à la volonté du patient », selon les mots de son vice-président, Jean-Marc Sauvé. Or M. Lambert « avait, avant son accident [en 2008], clairement et à plusieurs reprises exprimé le souhait de ne pas être artificiellement maintenu en vie ».
Cette évolution m’apparaît très importante à observer. elle signe une lente évolution du droit, qui suit celle de la société, sur le rapport au droit à mourir.
Elle doit être mise en rapport avec une autre évolution, celle du rapport démographique. Est-ce parce que la France vieillit, que le droit à mourir devient mieux accepté ?
A Pau une autre affaire médiatique, met en lumière les pratiques d’un médecin qui « aidait » les patients à passer en dehors du cadre prévu par les textes de loi. Les débats qui déchirent l’affaire Vincent Lambert expriment deux conceptions du rapport à la mort.
Par leur violence, ils montrent que les lignes sont en train de bouger.
