P. irrecevable en sa demande au titre de la clause de non-concurrence, l’arrêt retient que ce dernier s’est désisté de celle ci en première instance, et que la même demande ne peut être formée à hauteur d’appel ; en statuant ainsi, alors d’une part, que le désistement d’instance n’emporte pas renonciation à l’action, et que, d’autre part, les demandes nouvelles dérivant du même contrat de travail sont recevables même en appel, la cour d’appel a violé l’article R. 1452-7 du code du travail (Cass. soc., 5 janvier 2011, n° 08-70.060 FS-PB).
