- « Dès lors que la prime exceptionnelle, qui était versée postérieurement au départ à la retraite du salarié, constituait un avantage de retraite, la dénonciation de l’engagement unilatéral instituant la prime ne remettait pas en cause cet avantage après la liquidation de la retraite » (Cass. soc., 12 mai 2009, n°07-44.625).
Une fois de plus, après un Arrêt Tréfileurope trop peu commenté et surtout trop peu critiqué, la Cour de Cassation sanctifie tout ce qui est versé postérieurement au départ du salarié sous prétexte qu’il est retraité en lui donnant un caractère viager, et continue de fabriquer une notion d’avantage retraite sur une base légale aussi fumeuse qu’improbable.
